Foreclosure lawsuit against Phil Capitano is dropped

It was an issue in March 27 election

The lawsuit that was filed against former Kenner Mayor Phil Capitano for not paying his house note was dismissed Tuesday, according to 24th Judicial District Court records.

Capitano Phil.jpgPhil Capitano JPMorgan Chase started foreclosure proceedings against Capitano in January, as he was launching a new campaign for mayor, for failure to pay his mortgage since August. The suit became an issue in the campaign between Capitano and Mike Yenni, chief administrative officer for Mayor Ed Muniz.

Yenni won the March 27 election 57 percent to 43 percent and will take office July 1.

Capitano said his house in the Southlake Villages subdivision was never in danger of foreclosure. He said he paid the amount he was in arrears, plus interest and penalties, on March 12. On his campaign website is the image of a check he wrote to Chase Home Finance for $22,652.47.

The public auction to sell his house had been set for next Wednesday.
